A clear definition of what is considered sensitive information subject to such rules and directives has not yet been established.
This is otherwise called Consent, but many people have a very constrained definition of Consent, so I am happy to indicate it is rules for how the data can be used. When I 'used' I also mean the broadest definition. There no network that I know of that provides a view of how the HIE was used to expose the Patient data.

Although we do have HIPAA, GINA, 42-CFR Part 2, and many state augmentations. Healthcare does have some unique issues, like that the data can't be revoked or recalled. The issue is somewhat unique to the USA, because of the extreme fragmented Privacy regulations.
Note that there is a difference between the activity of health information exchange (the verb) and an HIE (Health Information Exchange – the noun). A key feature of the regulations is that they apply to HIPAA Covered Entities (CEs) and Business Associates (BAs).
I’m going through an HIE implementation right now with a local HIE here in Georgia. There’s definitely an art and a science in that gathering of data pre-visit and post-visit. Then I’d go in and the HIPAA paperwork was on paper and I had to sign that. I even paid my co-pay on the IPad. It was beautiful.
